Terms of Service

Zen Marine Charter offers private yacht charter experiences aboard our vessel ("Lovin' Life," a 57' Prestige 550 Flybridge), operating from the Miramar Beach / 30A area of Florida. Charters are operated by a licensed captain and crew. Maximum capacity is 12 guests. Charter options include sunset, half-day, and full-day experiences.

• Bookings are made through the Site and are confirmed only once your deposit is received and you receive a written confirmation.
• You must be at least 18 years old to book and must provide accurate guest and contact information.
• Charter start times and durations are as stated at booking. Please arrive at the marina at the time stated in your confirmation; late arrivals do not extend the charter end time.

• Prices are as displayed at the time of booking and may include applicable taxes, fees, and fuel surcharges.
• A 50% deposit is due at booking to reserve your date, with the remaining balance due 30 days before the charter date.
• Payments are processed securely through Stripe. If offered, financing may be available through Affirm.
• Add-ons (catering, photography, décor, beverages, and similar) are billed as selected and are subject to these Terms.

Crew gratuity is included / not included. If not included, a customary gratuity for the captain and crew is appreciated.

• Cancellation by you: If you cancel, a 50% refund of amounts paid will be issued, or a tiered schedule: cancel at least [X] days before = [−25%]; [Y] days = [−15%]; less than [Z] days = no refund. The deposit may be non-refundable.
• Rescheduling: We will make reasonable efforts to accommodate a one-time reschedule subject to availability if requested at least [X days] in advance.
• Cancellation by us (including weather): see Section 6.

The captain has sole discretion to delay, shorten, modify, or cancel a charter for weather or safety reasons. If we cancel for unsafe conditions, you will be offered a rescheduled date or a refund as described in our weather policy. The captain's decisions regarding the safety and operation of the vessel are final.

• Guests must follow all instructions from the captain and crew at all times.
• Do not exceed the stated guest capacity. Bringing additional guests may result in denial of boarding without refund.
• Illegal drugs and illegal activity are strictly prohibited on board.
• Alcohol policy: permitted for guests of legal drinking age (21+); we reserve the right to refuse service or terminate the charter for intoxicated or unsafe behavior.
• You are responsible for any damage to the vessel or equipment caused by you or your guests.
• The captain may terminate the charter without refund for unsafe, illegal, or abusive conduct.

Boating and water-based activities involve inherent risks, including risks of injury, illness, property loss, and, in rare cases, death. By booking and boarding, you and your guests voluntarily assume these risks. You are responsible for ensuring your guests, including minors, are supervised and follow safety instructions. A separate signed liability waiver may be required before boarding.

To the fullest extent permitted by law, Zen Marine Charter and its owners, captain, and crew are not liable for indirect, incidental, or consequential damages, and our total liability arising from any charter or use of the Site will not exceed the amount you paid for the applicable charter. Maritime law limitations may apply.

You agree to indemnify and hold harmless Zen Marine Charter, its owners, captain, and crew from claims, damages, or expenses arising out of your or your guests' breach of these Terms or conduct during a charter.

We may capture photos or video during charters for promotional use. If you prefer not to be featured, tell the crew.

All content on the Site (text, images, logos, and design) is owned by or licensed to Zen Marine Charter and may not be used without our permission.

You agree to use the Site lawfully and not to disrupt, misuse, or attempt unauthorized access to it or to other users' information.

The Site and services are provided "as is" without warranties of any kind, except as required by law.

These Terms are governed by the laws of the State of Florida, USA, and applicable U.S. maritime law, without regard to conflict-of-law rules.

We may update these Terms from time to time. The updated version will be posted with a new "Effective date," and continued use of the Site or services constitutes acceptance.
